Public Offer
This document constitutes the official offer of https://morgenshtern.love/ (hereinafter referred to as the “Seller”), which sells goods through its online store, to enter into an agreement under the terms set forth herein.
In accordance with Article 457 of the Civil Code of the Kyrgyz Republic, this document is deemed an offer.
The Agreement is concluded by the acceptance of this offer by any person responding to it (hereinafter referred to as the “Buyer”). The written form of the Agreement shall be considered observed pursuant to Article 456 of the Civil Code of the Kyrgyz Republic. Full and unconditional acceptance of this offer is the Buyer’s placement of an order on the website https://morgenshtern.love in the manner established herein. The Seller may withdraw the offer at any time prior to its acceptance by the Buyer.
This offer is addressed to individuals.
1. Subject of the Agreement
1.1. Under this Agreement, the Seller undertakes, under the terms and conditions set forth herein, to transfer into the Buyer’s ownership the goods ordered by the Buyer from among those offered for sale on the website https://morgenshtern.love.
1.2. The Buyer agrees to pay for and accept the goods ordered in accordance with this Agreement.
2. Order Placement Procedure
2.1. Goods are ordered on the website https://morgenshtern.love (hereinafter, the “Website”) by selecting items offered for sale and completing the corresponding form.
2.2. When placing an order, the user provides the following information:

Delivery address or valid postal address if the order is to be delivered by mail
2.3. The Buyer is responsible for the accuracy and reliability of the information provided when placing an order. If the Buyer provides incorrect information, the Seller shall not be liable for any resulting adverse consequences, including but not limited to delayed or omitted notifications regarding order processing or delayed delivery of Goods.
If incorrect contact information is provided and the Seller is unable to reach the Buyer within two days from the time the order is placed, the order shall be considered canceled.
2.4. After the Buyer submits the order through the form provided on the Website, the order is sent to the Seller for processing.
2.5. During order processing, the Seller verifies the accuracy of the Buyer’s information, prepares the order, and determines approximate delivery dates based on the specifics of the order.
2.6. If any errors or inaccuracies are found, the Seller’s representative will contact the Buyer via the email or phone number provided to clarify order details.
2.7. An approximate delivery date is displayed on the Website at checkout; however, the Seller reserves the right to determine the exact delivery date.
2.8. The exact delivery date is communicated to the Buyer by phone or email using the contact details provided.
2.9. If the ordered Goods are unavailable in the Seller’s warehouse, including for reasons beyond the Seller’s control, the Seller may remove such Goods from the order and notify the Buyer.
2.10. If Goods are removed from the order, the Seller shall refund their cost to the Buyer by transferring funds to the account used for payment.
3. Payment for Goods
3.1. The Buyer pays for the order in full at the time of placement via a non-cash payment form provided on the Website, which completes the order process.
3.2. When placing an order, the Buyer pays both the price of the Goods and the cost of delivery.
3.3. The price of each item offered for sale is listed on the Website in the respective product section. Prices are stated in Russian rubles and cannot be changed after the Buyer accepts this offer.
3.4. Delivery charges are not included in the price of the Goods and are calculated separately during checkout.
4. Delivery of Goods
4.1. The Buyer may choose one of the following delivery methods:
4.1.1. Courier delivery to the address provided by the Buyer.
4.1.2. Postal delivery (transfer of a properly prepared parcel to the Boxberry postal service) to the address provided by the Buyer.
4.2. Courier delivery is carried out by the Seller or by third parties engaged by the Seller and is paid for by the Buyer.
4.3. An approximate delivery time to the Buyer’s specified address is provided at checkout.
4.4. The exact delivery time is communicated to the Buyer via phone or email.
4.5. The Seller is not liable for delays caused by postal or courier services after the Goods have been handed over to them.
4.6. Postal delivery to the Buyer’s specified address is carried out at the Buyer’s expense.
4.7. Postal shipments are dispatched within three (3) business days after the Buyer places the order; however, the exact delivery time depends on the speed of the transport companies.
4.8. If the parcel is returned to the Seller due to the expiration of the storage period, any re-shipment will also be at the Buyer’s expense.
4.9. The Seller’s obligation to deliver the Goods is fulfilled at the moment the Goods are handed over to the Buyer or at the moment they are transferred to the postal organization.
5. Acceptance of Goods
5.1. When receiving Goods from a courier, the Buyer shall inspect the Goods for quantity, assortment, completeness, and quality upon receipt, confirmed by signing the delivery note.
5.2. When receiving Goods at a postal office, inspection for quantity, assortment, completeness, and quality shall be carried out at the postal facility.
5.3. The Buyer has the right to refuse Goods that do not comply with the terms of the Agreement, are delivered in damaged packaging, or lack accompanying documents — when delivery is made by a courier service.
5.4. Ownership and risk of accidental loss pass to the Buyer at the time the Goods are received.
5.5. The terms of exchange and return of Goods of proper or improper quality are set out in the Return Policy published at: https://morgenshtern.love/page/exchange. By accepting this Offer, the Buyer also agrees to the Return Policy.
6. Warranties and Liability
6.1. The Seller guarantees that the Goods are new, functional, and ready for use.
6.2. The warranty period is determined in accordance with the manufacturer’s warranty and begins on the date the Buyer receives the Goods.
6.3. The Seller is not liable for damage caused to the Buyer as a result of improper use of the Goods by the Buyer or any third party.
6.4. If the Buyer selects postal delivery, the Seller is not responsible for the delivery time after the Goods have been handed over to the postal service.
6.5. The Buyer is responsible for the accuracy of the information provided when placing the order.
7. Force Majeure
7.1. The Parties shall be released from liability for failure to fulfill or improper fulfillment of their obligations if such failure results from circumstances beyond their control that could not have been foreseen or prevented by reasonable means and which make the performance of the Agreement impossible, arising after its conclusion. Such circumstances include, for example: natural disasters unusual for the region, economic or sanitary crises, blockades, military actions directly affecting the Parties, and acts adopted by state or local authorities or international organizations.
8. Final Provisions
8.1. All notices, messages, and correspondence between the Parties shall be sent via email — from the Buyer’s email address provided during acceptance of the offer, and from the Seller’s email address specified in this Offer.
8.2. All disputes, disagreements, or claims arising from or relating to this Agreement, including those regarding its performance, violation, termination, or invalidity, shall be resolved in accordance with the mandatory pre-trial (claim) procedure.
8.3. A claim sent electronically is legally valid if it is sent from the email address provided by the Buyer when placing the order or from the Seller's email specified in this Offer.
8.5. If any provision of this Agreement is deemed invalid by a court, the remaining provisions shall remain in force.
8.6. This Agreement is drafted based on the understanding that the Buyer purchases the Goods for personal use.
